Terms and Conditions for Oly's Refer-a-Friend Program

*The $250 Prezzee eGift Card terms and conditions are as follows:

1.      The Refer-a-Friend Program (the Program) is conducted by Oly Pty Ltd (ABN 69 674 252 629) (Oly) and will run for the period from 01/03/2025 until 31/08/2025 or such earlier date that the Program is terminated by Oly in accordance with clause 9 (the Program Period).

2.      To be eligible to participate in the Program, you must be:

a.      at least 18 years of age; and

b.      an existing Oly Novated Lease customer, Maxxia customer, or Maxxia Pty Ltd employee[HWLE1] .

3.      You may participate in the Program by having a friend or family member (a referee) who is not an existing Oly customer complete and submit the official entry form on this page in full, including your name, email and contact phone number as the referrer (a Referral Submission). By participating in the Program, you accept these terms and conditions.  Oly is not liable for Referral Submissions that are misdirected, delayed, lost, incomplete or incorrectly submitted for reasons outside Oly's reasonable control.

4.      In order to be valid, Referral Submissions must be completed and submitted by the referee themselves.  Referral Submissions that you complete and submit on behalf of the referee will be deemed invalid.

5.      Oly will provide you with a $250 Prezzie Smart eGift gift card for each Completed Referral (the Reward). A Completed Referral will only occur when:

a.      Oly has received a valid Referral Submission during the Program Period that lists you as the referrer;

b.      Oly has contacted the referee in the Referral Submission to verify that they were the person who submitted the Referral Submission, and that they are not an existing Oly customer; and

c.      the referee has agreed to take up a new novated lease with Oly, and the novated lease agreement has been settled.

A referral will not be a valid Completed Referral if you are not (or have ceased to be) an eligible participant (as defined in clause 2) at the time that the referee's novated lease agreement is settled.  You are only entitled to one Reward per referee, even if you submit multiple Referral Submissions for that referee.

6.      There is no limit to the number of Referral Submissions that you can make during the Program Period. However, Oly reserves the right to verify: (i) the eligibility of each Referral Submission before contacting the referee; and (ii) the validity of each Completed Referral before issuing a Reward.

7.      The Reward cannot be exchanged for cash or any other form of compensation.  The Prezzee Smart eGift Card may be used subject to the terms and conditions that to apply to the card by Prezzee.  For the full Prezzee eGift Card Terms and Conditions (Terms of service) please visit www.prezzee.com.au/doc/terms-of-service/.  You agree that if a Reward (or element of a Reward) is unavailable for any reason, Oly may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.

8.      If there is any dispute or disagreement between you and Oly about the Program, these terms and conditions or the validity of any Referral Submission or Completed Referral, Oly will take reasonable steps to discuss that dispute or disagreement with you.  However, any decision made by Oly in connection with the Program (in relation to whether a valid Completed Referral has occurred) is final.

9.      Oly reserves the right to modify, suspend, or terminate the Refer-a-Friend Program at any time without prior notice.  In the event of Program termination (or if the Program Period expires in accordance with clause 1), Oly will honour all Referral Submissions received prior to the termination or expiry date that result in a Completed Referral (even if final settlement of the referee's novated lease occurs after the termination or expiry date), provided that you are still an eligible participant (as defined in clause 2) at the time that the referee's novated lease agreement is settled.

10.   Once a Completed Referral has occurred (in accordance with clause 5), Oly will contact you at the start of the following calendar month to notify you and arrange delivery of your Reward.  By participating in the Program, you request that your full address not be published.

11.   In order to arrange delivery of Rewards, Oly will contact you using the contact details that were provided for you in the relevant Referral Submission.  It is your sole responsibility to ensure that your referee provides the correct contact details for you in the Referral Submission.  In the event that Oly is unable to contact or locate you using the contact details in the Referral Submission, the Reward will be kept for three (3) months from the day that the first contact attempt was made. If, following the expiry of those three (3) months, you have still not claimed their reward, you will be taken to have forfeited that Reward. The Reward will not be re-distributed.

12.   All Referral Submissions are the property of Oly. The information about you in the Referral Submission collected by Oly is collected for the purpose of conducting the Program, including contacting your referee and assessing the validity of the Referral Submission. The information about the referee contained in the Referral Submission is collected by Oly for the purpose of contacting the referee to discuss Oly's products and services, and for the purpose of conducting the Program.  Oly may also use this information for direct marketing and online targeted advertising.  Oly may disclose this information to other entities in the MMS Group, our agents, contractors and service providers (including our web and IT administrators, mail houses, advertising service providers and advisers), some of whom may be located overseas (including The United States of America, the Republic of Ireland, India, China, Sri Lanka and the Philippines). The Oly Privacy Policy contains important information about how we collect, hold, use and disclose personal information, the security of your personal information, how you (or your referees) may access and correct your (or their) personal information, and how you (or your referees) can make a privacy complaint and how Oly will deal with such a complaint. 13.   You acknowledge and agree that any reward you receive is not a salary, however you may need to declare any reward as income for tax purposes.  Oly is not responsible for any tax implications arising from you winning a prize.

14.   Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as similar consumer protection laws in the States and Territories of Australia.  See www.accc.gov.au for more information about those rights.

15.   Subject to clause 14, Oly is not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this Program or any Reward, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).

Terms & Conditions

1. The referrer must be an existing Oly Novated Lease customer to participate in this promotion at the time that the referred friend’s lease has settled. 2. The referred friend must be a new customer of Oly. A ‘new customer’ is defined as an individual who has not had a novated lease with Oly in the last twelve months. 3. The program excludes the refinance of residual values and re-novations. 4. The dollar value of the Eftpos card is as promoted on our website at the time of referral. 5. To receive the Eftpos card, the Novated Lease Customer’s name must be given at the initial point of contact with Oly by the referred person. 6. The benefit cannot be redeemed for cash. 7. The Eftpos card cannot be issued until the referred friend is approved and the Novated Lease has settled. 8. The promotion cannot be applied retrospectively. 9. Eftpos cards will be issued via post as soon as possible following settlement. 10. The benefit cannot be transferred to another person or party. 11. There is no limit to the number of friends you can refer. 12. You cannot refer yourself for a subsequent lease. 13. The person you are referring must be aware of the benefit you receive. 14. This program only applies to the referral of friends which remains at the sole discretion of Oly to determine eligibility. It does not apply to authorised signatories, payroll, directors or persons of influence referring work colleagues within the same organisation. Oly has separate promotional campaigns that are available to businesses to promote the benefits of novated leasing within an organisation. Please contact your account manager to discuss such opportunities further. 15. This offer is subject to availability. 16. Oly reserves the right to cancel this offer at any time without prior notice. Oly reserves the right, in our sole discretion, to remove your access to this program if you breach our fair and acceptable use policy, or we have otherwise formed the view that you are scamming this program. Privacy: to participate in this program, existing customers must disclose to their friend that they are an existing customer of Oly and will be eligible to receive a refer a friend benefit. Oly does not provide existing customers with any information about referral friends, except for the fact that someone you referred has become a customer and that you will therefore receive a refer-a-friend benefit.
